Terms of Service

1. General provisions
- These Terms of Service ("Terms") govern the provision of electronic services by Evergreen Group Sp. z o. o. Sp. K., registered office in Warsaw (02-797), ul. Franciszka Klimczaka 17/80, Poland, entered in the Register of Entrepreneurs of the National Court Register under number KRS: 0000534060, Tax ID (NIP): 7010452658, Statistical number (REGON): 360370198 (the "Provider").
- The service is available at https://getattent.com (the "Service" or "Attent").

2. Definitions
- User – any natural or legal person who uses the Service.
- Account – a set of data associated with a User, protected by a password.
- Services – features offered by the Provider, including: public website scanner, AI Commerce Readiness Checker, LLM Visibility Monitor, Uptime Monitor, and report exports.
- Plan – a package of features and limits available to the User according to the current pricing published in the Service.
- Consumer – a User who is a consumer within the meaning of Article 22¹ of the Polish Civil Code.
3. Scope of services
- The Provider offers the following Services:
- public website scan without registration, with limits stated in the Service;
- User Account with access to features of the active Plan;
- audit of a website's readiness for LLM-powered search (ChatGPT Search, Google AI Overview, Perplexity, Brave Search, Gemini) and agentic commerce protocols (ACP, UCP, MCP);
- brand visibility monitoring in selected language models through periodic test queries;
- uptime monitoring of specified URLs;
- generating and exporting reports in PDF and CSV formats;
- API access within the Enterprise Plan.

- Use of the Service requires a device with internet access and a modern web browser with JavaScript and cookies enabled.
4. Account registration
- The public scan does not require Account registration.
- An Account is created by filling in the registration form (email address, password) and accepting these Terms and the Privacy Policy. The agreement for the provision of Services is concluded for an indefinite term upon Account creation.
- The User undertakes to provide accurate information and to keep the Account password confidential.
- A newly created Account is activated on the Free Plan, with limits stated in the pricing.
5. Fees and paid Plan activation
- Plan prices are stated in euro (EUR), net of taxes. VAT is added in accordance with applicable regulations.
- A paid Plan is activated based on an order placed at [email protected]. The Provider issues a VAT invoice, and the Plan is activated manually once payment is credited to the Provider's bank account.
- The billing period for a paid Plan is one month or one year, according to the User's choice and the current pricing.
- Paid Plans do not renew automatically. Failure to pay for the next billing period results in downgrading the Account to the Free Plan, with continued access to historical data within the limits of the new Plan.
6. User obligations
- The User shall use the Service in accordance with these Terms, applicable law, and good practice.
- The User shall not provide unlawful content and in particular shall not:
- request scans of URLs to which the User has no legal title or the owner's consent;
- use the Service in a way that infringes copyrights, trademarks, or other rights of third parties;
- perform network attacks, circumvent Plan limits, or otherwise disrupt the operation of the Service;
- share Account credentials with unauthorized persons.
- The User represents that they have all rights and consents necessary to enter data into the Service (including URLs and monitored phrases) and to have the Provider process such data as part of the Services.
7. Liability of the Provider
- The Provider makes reasonable efforts to ensure continuous and uninterrupted operation of the Service but does not guarantee uninterrupted availability and reserves the right to schedule maintenance windows.
- The results of scans, recommendations, and reports are provided for informational purposes only and do not constitute legal, tax, or business advice. The Provider is not liable for decisions the User makes based on scan results.
- The Provider uses third-party services (including OpenAI, Google, Perplexity, Brave, Hetzner Online GmbH). The Provider is not liable for limitations or outages caused by such third parties.
- For Users who are not Consumers, the Provider's liability is limited to the amount of fees paid by the User during the 3-month period preceding the event giving rise to liability. Liability for lost profits is excluded.
8. Complaints
- The User has the right to file a complaint regarding the Services at [email protected].
- The complaint should include: the User's identification (Account email address), a description of the issue, and the User's request.
- The Provider will respond to the complaint within 14 days of receipt, by email.
9. Right of withdrawal (Consumers)
- A Consumer who has concluded a distance contract may withdraw from it within 14 days of its conclusion without giving any reason, by sending a statement to [email protected].
- The right of withdrawal does not apply to Services the performance of which has begun with the Consumer's express consent before the withdrawal period expires, provided the Consumer was informed that they would lose the right of withdrawal upon full performance (Article 38(1)(1) of the Polish Consumer Rights Act).
- Activation of a paid Plan is treated as the commencement of Service performance with the Consumer's express consent.
10. Termination
- The User may terminate the agreement at any time by deleting the Account in the panel or by sending a request to [email protected].
- The Provider may terminate the agreement with immediate effect in case of a material breach of these Terms, including the conduct described in clause 6.2, after calling on the User to cease the breach.
- After termination, User data is deleted or anonymized within the scope and timeframes specified in the Privacy Policy.
11. Personal data
The rules for processing Users' personal data are set out in the Privacy Policy available at https://getattent.com/en/privacy.
12. Changes to the Terms
- The Provider reserves the right to change these Terms for valid reasons, in particular due to changes in law, changes in the scope or nature of the Services, or organizational changes.
- The User will be notified of changes by email to the address associated with the Account at least 14 days in advance. Failure to accept the changes entitles the User to terminate the agreement with immediate effect.
13. Final provisions
- Matters not regulated by these Terms are governed by Polish law, in particular the Civil Code, the Act on providing services by electronic means, and the Consumer Rights Act.
- Disputes arising from the agreement shall be resolved by the court of general jurisdiction competent for the Provider's registered office, subject to mandatory rules of jurisdiction applicable to Consumers.
- Consumers may use out-of-court dispute resolution mechanisms, including the ODR platform available at https://ec.europa.eu/consumers/odr.
- These Terms enter into force on April 9, 2026.
